Jacqueline Smolik, PWS and April Hasse attended the USACE Galveston District (SWG) Regulatory Division Outreach Event on January 30, 2020 where USACE regulatory staff discussed the Navigable Waters Protection Rule (NWPR). The NWPR will go into effect 60 days after publication (end of February). USACE headquarters is in the process of developing a guidance document to help consultants and applicants understand how the NWPR will affect their projects. It is important to note that lawsuits typically occur immediately after rules go into effect. These lawsuits delay changes in regulatory processes.
